Fleep Mattress – Limited 10-Year Warranty

Your new FLEEP mattress is covered by a limited 10-year full replacement Warranty. We will replace or repair your new FLEEP mattress if in the 10-year period following its purchase date, it proves defective due to a defect in manufacturing or in the materials covered under this Warranty.

Replacement or repair applies to all components of the mattress and involves no deductible on your part.

Details and certain restrictions are included in the full description of this Warranty.

Description of the Limited Warranty

What does the Warranty cover and who can apply it?

Matelas FLEEP Inc. (“FLEEP”) guarantees that it will replace or repair, at its sole discretion, the purchaser’s FLEEP mattress sold in North America by Matelas FLEEP Inc. or by an authorized FLEEP retailer if the product is defective due to a defect in manufacturing or in the materials, subject to the restrictions described in this Limited Warranty.

This Limited Warranty is valid only for the original purchase of a new FLEEP mattress made directly on fleepbed.com or from an authorized retailer.

An “original purchaser,” for the purposes of this Limited Warranty, is the person who buys the mattress directly on fleepbed.com or from an authorized FLEEP retailer. The mattress must be used by the consumer strictly for his or her personal use.

A person who buys the product, without permission from FLEEP, with the intention to sell the product is an unauthorized reseller. A person who buys a FLEEP mattress from an unauthorized reseller is not an original purchaser for the purposes of this Limited Warranty. If the purchaser is not an original purchaser, he or she undertakes to accept the product “AS IS,” “WITH ALL DEFECTS,” and without a warranty.

A new warranty will not be issued when a FLEEP mattress is replaced. In the case of a replacement product, the warranty will start on the initial purchase date of the replaced product.

Responsibilities of the original purchaser

The purchaser is responsible for complying with the normal conditions of use of the mattress.

Normal conditions of use require that the mattress always lies on a completely flat, stable surface. This surface must be able to effectively support the combined weight of the mattress, its users, and, as the case may be, the bed base. A central leg may be required for additional strength. If the mattress or the mattress and bed base together are not supported in an appropriate manner, your Limited Warranty may be invalidated.

Normal conditions of use require that the FLEEP mattress always lie on a completely flat and stable surface, a bed base without springs, or an adjustable base. These must be structurally capable of supporting the weight of the mattress and its user(s). It is the responsibility of the purchaser to ensure that the mattress is lying on a surface that can bear the total weight applied to its structure.

Normal conditions of use require that if a bed base is used on a metal frame, the frame must be equipped with at least 5 or 6 support legs in the case of a queen- or king-size bed, or at least 4 support legs in the case of a single or double bed. The purchaser must ensure that the metal frame has enough structural strength to support the mattress, based on the number of crossbars on the frame.

If the purchaser uses a bed base, box spring, adjustable bed base, or bed frame that is inappropriate for the mattress, such use will invalidate this Limited Warranty. FLEEP reserves the right to require that the purchaser submit proof of the quality of the bed base, adjustable bed base, or bed support used under the mattress.

FLEEP reserves the right to invalidate this Limited Warranty if the mattress support is deemed, at FLEEP’s reasonable discretion, inadequate or if the structure is deemed to be unsafe.

What the Limited Warranty covers

This Limited Warranty covers the following items under normal conditions of use:

  • Deterioration of the mattress due to visible body impressions more than 1 inch (2.5 cm) deep that are not associated with a dip or sag due to inappropriate use or inadequate mattress support.
  • Any physical defect in the mattress that can cause fissures or splits in the foam under normal use and appropriate handling (as described in the care and use guidelines).
  • Any manufacturing defect in the mattress cover assembly or zipper. FLEEP may, at its sole discretion, repair or replace the cover provided with the mattress.

What the Limited Warranty does not cover

  • Normal increase in the softness of the FLEEP foam, which in no way affects the therapeutic properties of the mattress.
  • Comfort preference.
  • Improper use or damage caused to the structure or fabric of the mattress cover (or both), including, but not limited to, burns, cuts, rips, damage caused by spilt liquids, and stains. However, if a defect covered by the Warranty was not caused by improper use, the mattress will be covered under the standard warranty.
  • Damage related to the use of an inappropriate bed frame, bed base, or adjustable base. See below for a description and illustrations of an inappropriate bed frame.
  • Mattresses sold by unauthorized resellers.
  • Temporary odor of a new mattress.
  • Mattresses sold “as is” or as “preconditioned,” “reconditioned,” “used,” “comfort-related returns,” “returns,” “second hand,” or any other similar expression indicating that the product is not “new” or “premium quality,” or was bought previously or used by another consumer.

General conditions regarding replacement of a FLEEP mattress

Subject to provisions to the contrary stipulated in this Warranty, FLEEP will assume all costs of replacing or repairing the mattress if it is deemed defective during the 10-year term of this Limited Warranty. FLEEP will pay all shipping costs associated with the repair or return of the mattress.

FLEEP undertakes to return a replacement mattress no later than 30 days after receiving the defective mattress at its plant. Shipping costs for the replacement mattress will be charged to the purchaser. However, shipping costs will under no circumstances exceed FLEEP’s standard shipping costs.

In the case of a replacement product, the Warranty period will start on the initial purchase date of the replaced product. A new Warranty will not be issued with the replacement product.

Other restrictions regarding the Warranty

If a warranty claim is filed and a replacement under warranty is deemed necessary, the purchaser must return the original FLEEP product before the replacement can be made.

FLEEP accepts no liability for accessory or indirect damages resulting from the use of this product or from noncompliance with the Warranty. Replacement of the product or awarding of a credit toward a replacement product as provided for herein is the sole remedy for any breach of warranty. No express or implied warranties exist, including warranties of merchantability or fitness for a particular use except by the provisions of this Limited Warranty.

This Warranty grants the purchaser certain legal rights, and you may have other rights under current laws in your province or state. In the event that any provision of this warranty is prohibited by such laws, this provision will be null and void, but the remainder of this warranty will remain in effect.

Please keep this document and your invoice as they are required for the application of this Warranty. This Warranty is intended for consumers and must not be used for commercial purposes.

Description and illustrations of an appropriate bed support

Conventional bed base, adjustable bed, or platform bed

base-de-lit

  • Stable surface
  • Completely flat
  • With a central support

Normally, most modern bed bases and beds meet these criteria.

Attention: Box springs are not recommended. They are designed to support conventional spring mattresses and are somewhat flexible, whereas your FLEEP mattress requires a solid base. Noncompliance with these guidelines may lead to termination of the Warranty on the FLEEP mattress, and no changes can be made to a box spring to make it acceptable under the FLEEP Warranty.

Floor

sol

  • Only if the room in which the mattress is installed is not damp
  • Only if the temperature of the floor does not vary

Attention: A floor whose temperature varies from season to season or is too damp can lead to condensation under the mattress and the appearance of mold. A mold-stained mattress is no longer covered by the Warranty.

Slatted bed

sommier

  • Slats 6 inches apart or less
  • Solid slats (not adjustable)
  • Flat slats (not curved)
  • Central support

Attention: Many European-style beds do not comply with our recommendations. The slats are curved and often flexible to increase the comfort of European mattresses, which are not designed like North American mattresses.

Care and use guidelines

Caring for your mattress

We recommend unzipping the mattress cover and removing it for hand washing with a mild, dry detergent. Before putting the cover back on the mattress, make sure that it is completely dry. Machine washing or drying your FLEEP mattress cover is not recommended.

Protecting your mattress

To make it easier to care for and protect your FLEEP mattress, it is a good idea to use a mattress protector with a waterproof membrane on at least 5 of the 6 sides. We recommend that you purchase a FLEEP mattress protector, which fits the FLEEP mattress perfectly without affecting its comfort. It protects the mattress from liquids, slows the development of allergens, bacteria, and mites, and allows the mattress to breathe.

Rotating your mattress (head to foot)

Rotating the mattress from head to foot as often as possible is advised. That way the part of the mattress supporting your head will subsequently support your feet, and vice versa. Rotating the mattress also prolongs the life of your FLEEP mattress because it gives the cells in the foam time to regenerate.

Washing your mattress in case of stains

If a liquid stains the mattress, follow the steps below. FLEEP cannot guarantee that the stain or odor will disappear completely.

Steps to follow:

  • Remove the zippered FLEEP mattress cover.
  • Sponge up as much liquid as possible with a towel, pressing on the material as needed.
  • Once the excess liquid is removed, let the mattress air dry. Use a fan to speed drying, as needed.
  • Never use bleach.

Flipping the mattress over

Thanks to their unique design, FLEEP mattresses are reversible! We recommend you turn them over each season if you like both comfort levels. If you only like one of the comfort levels, it is not necessary to flip your mattress.

Folding the mattress

If your mattress remains folded for some time at temperatures below 10°C (50°F), do not try to force it flat. It will return to its natural shape as the room heats up. This can take several hours.

Shipping and storage

The mattress must be shipped or stored flat, rather than on its side or folded over.

Electric blankets and cushions

Because of the foam’s sensitivity to temperature, heating the mattress may prevent it from reacting properly to the temperature of your body and may affect its performance. Therefore, use of an electric blanket or cushion on your mattress is not recommended. What’s more, your mattress may be damaged by prolonged exposure to the heat electric blankets and cushions can produce.
